My case was approved by BEC on July 18. My attorney says that my 140 has to be filed by July 31 to be eligible to file under July visa bulletin [by 17th August]
Is his interpretation correct?
I can not do concurrent for a few more days, until my family returns from India.
If I go with 140 now, I am afraid the 140 receipt may not arrive in time for me to file for 485.

Hello
Whm i transferred my H1B to another company, i missed filing filing for H4.
So she was having I 94 of my old company till Nov 2006.
Whn i changed company agn in Dec 06, thats whn i relised her i 94 expired, we submited I 539 for her xtension. but couldnt get it. she exited the country before 180 days of her expiration and planning to apply for new visa in India.
Did anybody had the same experience. Pls share.

My wife had concived for 3 days in June. During immigration medical exams Doctor gave her MMR shots and stated don't get pregnant for another 3 months.
After 15 days, We came to know that she is pregnant.
last week my wife had miscarriage after 18 weeks of pregnancy. Not sure it's because of MMR or something else.

As Professor Regina Germaine of the Georgetown University Law Center observed in an email message to an Immigration Professors' Listserve, "the criteria for release has always been (since 1996) the 3 factors mentioned by John Morton - 1) ID, 2) not a danger or flight risk, and 3) credible fear. And the lack of one or more of these factors is cited when ICE refuses to release someone."
So, has Morton announced a new policy or has he simply restated the existing policy in a way which suggests release, but, in fact, will lead to continued detention of asylum seekers?
Another unanswered issue is whether the policy will be followed by ICE officers throughout the country. Professor Margaret Taylor of Wake Forest University suggests it's an open question. "Hopefully there will be 'buy in' and compliance in the field offices with this policy, but history suggests otherwise."
For now let's take the Administration at its word. But time will tell whether the draconian policy of incarcerating people who seek refuge in America has finally come to an end.

Does anyone know if there would be some kind of record about
when and how many times we have spoken to the IIO.
Like will a IIO be able to look at one's receipt# and say if they have spoken to an IIO earlier that day or whenever that is?

this is great, even after working with acrylics for a while, my portraits never got better than this!

Hi company A applied for my H1 in april 1st week.
they have got 2 rfe so far and now i am not interested in working with them(they also dont seem interested in replying to the 2nd rfe)
Another company is interested in filing my h1b.
what is the safest way to go about doing this.
should i let company B know that i filed with company A before.
Also will there be any problem in getting H1b approved because of my earlier filing

I should have elaborated this more. I read that ppl applying for H1B stamping were asked about this. They were actually issued 221 G and were asked to furnish extra documents and this was one of them.
I have no clue what is this and if this applies to everyone. I even found that ppl were asked to furnish notarized list of employees along with tax returns of the company. I hope this is not valid for every case.

Hi there
I am currently working on F1-OPT with company A. Company A filed for my
H1B visa and it got approved, which is yet to start from Oct 2010. But now I
got an offer from Company B. I have to get my H1 transferred to company B.
I have informed my current employer(Company A) about this transfer.
But actually they(company A) are planning to withdraw my H1B visa petition
from USCIS as I will not be working with them from Oct 2010.
I would like to know if this will affect my visa transfer.
Can someone please let me know how it works and suggest me what should I do
to get my transfer done?

What happens to the people who graduated from the institute and applied for gc on its basis?
It depends. If the University was never accredited by a recognized accreditation board, then USCIS would never have accepted that degree. If it was accredited before being shut down, then you might stand a chance. But if as someone has posted the university never had a .edu domain, then I doubt it was accredited by a recognized board at all.

No. He got the new I797 recently and does'nt have VISA.
Thats what probably triggered the 221(g).
They have to verify documents on his visa.
IV had few posts on this earlier in 2007, search for that. You can find some good information.
