My labor was filed with job title from the employer as IT Lead (O*Net Code - 11-3021.00, O*Net title - Computer and Information Systems Managers). I am having an opportunity to convert to full-time on EAD (I-140 approved, EAD received 18months back). The new job title is Software Engineer(possible O*Net codes - 15-1032.00/15-1021.00/15-1031.00, possible O*Net title - Computer Software Engineer/Computer Programmer). Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.
as far i have learnt from the discussions in forms "Title" should not be a problem.
But the O*Net Code should be the same.
Meaning new job should fall under the same job code.

Hi All,
How many of you gone through this postings in www.Murthy.com website.
"Priority Date Movement and H1B Extension Strategies"
This article states that one can't apply for 3 years H1b even if their I140 is approved and they should go for 1yr extension. In my case I am short of 20days to be eligible for 1yr extension. since my H1B expires 20days before my Labour filling date.
Note:
a) I dont have my visa stamped on my pp
b) My wife's H4 expires on July07 mine oct\07
c) I have already filed for 3yrs of H1B and H4 extension as of May before the PD became current.
1) So What are my options?
i) Apply for 485 and wait for EAD.
ii) Leave the H1B petition as such Apply EAD and wait for the decisions on my case
iii) Go to canda for 25 days and come back with out stamping and recapture the dates and apply for 1yr extension
iv) Go to canada get H1B stamped and go to INDIA for a month and get H4 stamping for my wife and come back and recpature the dates and get 1yr extension.
v)File 485 get receipt and go to INDIA for 3months and recapture the dates
and get 1Yr extn and come back in H1B.
vi) Don't File 485. Go outside country gain 21days and apply 1Y extn.
vii) with draw current petition and apply for my wife till 10\07.
2) What happens if my 3yrs extenson petition is rejected\RFE is sent? Will my wife be out of status bcos her h4 is valid only till 07/07.
what happens if she has to leave if the petition is cancelled. Her I94 is expired.whether she will face any problems at the airport.
3)Can she maintain a valid status after 07/07 if the case is still pending?
if Yes untill when?

Since H-1 B is an employers petition, It will be delivered to the employers place of business, unless you used an attorney in which case the attorney will have it.

I just did that, from Sr sw engr to sr sales conslt. Corporation would not care for details of AC21 , however if and when u send in AC21 letter to USCIS, make sure your job duties match that of ur previous job. rest shd be all cool. The new job u r getting into, is it a big firm and small?

Where does that put us considering the house bill didn't even make it to markup today?
I thought it was E-verify and our bill with some sunset bills. Now he excluded those things and added last item which Republicans never supports. So he is making this as suicide bill . This is all about politics. See how they turned back in last minutes. Now they created a image of Immi friendly but eventually they didn't fight for us. Bob was Anti in beginning and he introduce recapture so get our support now after becoming popular among us and our friends , relatives he is officially not stopping bill but killing it.

Thanks. So how can I find out more about what exactly got updated? On the USICS site, it shows that my AOS was updated in Dec 2007, but nowhere does it report what kind of update it was. Any thoughts?

I understand there will be stress headache etc... I just wanted to see if the cost of appealing a wrongly rejected 485 was something a H1b employee can afford.
BTW on lighter note:
For headache I use zandu balm
and for stress I do Yoga.
These dont cost as much as docs/lawyers in this country!!

So it looks like I have 2 independent questions:
1. Can an H1B be transferred to a new company once the H1B holder is in their 6+ year?
2. Can one port their EB3 case to EB2 with a new employer?
After reading around in forums, the answer for question 2 seems to be Yes and with some successful examples.
What is still not clear is questions one.
Any help please?

3. Is there a minimum time limit after joining aftre which only I can apply for extension..? No such limit...I feel it is good to have some pay stubs

It costs time, stress, sleepless nights, anxiety, restlessness and some hair loss(the list could be long for others) if you get a RFE relating to AC21, these are all bonus in addition to the money you spend for filing MTR.

Need some comments on my situation. My lawyer filed for my I-140, I-485, AP, and EAD on November 20th on EB2 Row Category. I just emails yesterday stating that my EAD card is sent to production, but they have asked for initial evidence on 485. Is it possible to review 485 without looking at the 140? I am not sure what that query is, but really hoping that it is not something serious. I've already waited for 16 months for my Labor to get approved. Please share your experiences, suggestions etc. regarding this.
