Today i called USCIS and opened my mouth to ask the IO (a nice sounding lady) about my I-485 status. Before i could say anything, she said if my application was received after April,2007, then she cannot tell anything as they are not processing cases filed after yet. She specifically said she cannot tell anything about Namecheck.
I politely thanked her and hung up. I think they stopped telling after everybody and his/her second cousin started calling. Is there any other way?.

I think one always has to take PR claims with a few grains of salt (yes, including Canon's). As always, I'll wait for the reviews to come out before making any judgements, but I'm afraid unless Nikon does something about their lack of ultra-long primes with VR and their lack of any usable PC lenses, I'm going to be a Canon convert (if / when I go DSLR).

My H1 and I-94 and My Wife's H4 and I94 expired on Sep 30th 2008 and applied for extension on July 7th 2008 with Company A. But Company A received an RFE on H1 extension,
At this movement I have a good offer from company B , can I transfer H1 using Receipt of H1 extension?

I guess you can use your old I-94 to travel canada. Please see following link.

I applied for H1B and Green Card Simultaneously in 2002. My first H1B expired in 2005. I am working on EAD. My questions are--
If I decide to change jobs and apply for H1B with the new company, am I subject to the QUOTA?
If I change jobs( in similar field) to another state in another service center, how is my case transfered to TSC from NSC?
Please reply.

I think your first point is valid. I would do the same thing. If you are using AP, I don't think you need to go for stamping.
Your second point is some what complicated. As your H1 is expiring in April, if you renew it later in July, it might go for consular processing, which means that you won't get the I 94 with the approval notice. In that case you need to reenter uisng a valid visa.

If you are e-filing, answer to Q 15 is not mandatory, so I guess if in doubt it's safe to skip it.

Q.#11 Dates ... is this the date I signed the I-765 application, or lawyer signed, or the date we mailed or the date USCIS recieved the application?:confused:
Q. #15 Current Immigration Status ... I researched on this forum and concur with those who say AOS.:)
Q.#16 Eligibility under 8 CFR 274a.12 ... Selected (c)(9)(). I filed during July-07 under EB2 category. Also this is what was mentioned on my original I-765 application that had been approved last year.:rolleyes:

Hi guys,
My H1-B visa is approved lastyear (Jan 2007).and I came to US on Mar 2007.
In my H1-B visa the DOB is wrongly entered.In my passport the DOB is correct.I havent checked this and i m in US now.When i went to Driving office to apply for my drivers license they asked me to correct the DOB in my VISA.
Can anyone helpme out how to change correct my DOB in my H1-VISA.
Whats the procedure to change my DOB in my Visa.
Any help is appericiated.

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?
I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

Given the fact that we have a sum total of all Applications in the system :
We should have a pretty good idea soon how the PD would stand.
We should be able to fill in a quick poll to see how the numbers get split up with our members to get a rough idea of the % age wait. The goal is, most folks now are aware of IV and atleast visit IV frequently. They should be able to add 1 unit to the count, so we have a rough idea of the wait times to calculate to understand realistically How long to wait for the GC Visa # allotment.

Since you have Valid H1b, using H1b is better option. EAD � you need to renew it every year. If you are in EAD, then you have to have AP (if you want to travel abroad) which also you need to renew every year.
If anything goes wrong in your I485 (just in case) you will be in trouble, but that is not the case if you are in H1B. I am not saying EAD is bad, but comparatively Valid H1b is a better option.
If your previous employer won't revoke I140, then no issues, even revoking of approved I140 by your previous employer will not have any effect as you have completed 180 days after filing your I485.

This post is on behalf of my friend who is a student in UK and planning to apply for US Student (F1) visa. Here are some of the queries he has. I am sure some of you would be able to answer the questions below.
Question 15: Home Address (Should this be home address of India or should it be local address of UK where the prospective student is a temporary resident)
Question 16: Home Telephone Number : Similar to Question 15, what should be the answer for home telephone number and mobile number for a temporary resident (student) in UK when applying for US Visa?

First, its a very very wrong assumption that your employer will not withdraw I-140. Sometimes even if they don't want to, to comply with govt. regulations they gotta do it.
I would suggest not to get into a situation where you have to invoke AC21 till clouds are clear.

Yeah many people got the I-140 update who files in July. What was your PD on LC Sub? If you pD was too old then you would have got your GC by now.
May be LC sub cases are jammed now.
